STORY FRUITION LLC CONSUMER HEALTH DATA PRIVACY POLICY

Washington's My Health My Data Act (MHMDA) requires businesses that collect “consumer health data” to publish a separate, standalone privacy policy describing that collection, distinct from their general privacy policy. This Consumer Health Data Privacy Policy is that standalone policy for Story Fruition LLC (“we,” “us,” or “our”). We are publishing it as a precaution: MHMDA defines “consumer health data” broadly enough to include data that only indirectly reveals or could be used to infer a physical or mental health status, and Missy, our AI-powered speech and presentation coaching experience, analyzes voice and speech patterns in ways that could fall within that definition even though Missy is not a health or medical product. This policy describes how we handle any consumer health data to the extent MHMDA applies to our processing, and it should be read together with our Privacy Policy at storyfruition.com/privacy-policy, which governs our handling of personal information more generally.
- WHAT IS “CONSUMER HEALTH DATA”?
Under MHMDA, consumer health data means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer's past, present, or future physical or mental health status. This includes data that directly describes a health condition, as well as data that is derived or extrapolated from non-health information — including through artificial intelligence — where that derived data is used to indicate a consumer's health status. It also includes biometric data collected to identify a consumer, such as a voiceprint.
For Missy specifically, this can include voice recordings and biometric identifiers (see Section 4 of our Privacy Policy), and any coaching feedback, score, or inference Missy generates about a user's confidence, nervousness, stress, or similar affect-related signals, to the extent that feedback reveals or could reasonably be used to infer a mental or emotional health status. It does not include a user's presentation content itself (the words, slides, or subject matter of a practice session) unless that content is used to draw a health-related inference.
- CATEGORIES OF CONSUMER HEALTH DATA WE COLLECT
- Â Voice recordings and voiceprints. Audio you provide to create and use your voice-cloned Missy agent, and any biometric identifier (such as a voiceprint) derived from it.
- Â Speech-derived coaching signals. Measurements Missy's AI generates from your speech, such as pacing, filler-word frequency, tone, or a confidence-related score, where that signal reveals or could reasonably be used to infer a physical or mental health status.
- Â Account and usage information linked to the above. Information that connects the data above to your account, such as session timestamps and device or browser information, where it is linked to consumer health data described above.
- SOURCES OF CONSUMER HEALTH DATA
We collect consumer health data directly from you when you use a voice feature of Missy. We do not purchase consumer health data about you from data brokers or other third parties, and we do not derive consumer health data from your use of other websites or apps.
- HOW WE USE CONSUMER HEALTH DATA
- Â To provide the coaching feedback, scores, and voice-cloned agent responses you request from Missy.
- Â To train and improve the Missy AI system, solely within Story Fruition LLC, as described in our AI Training Data Policy.
- Â To maintain the security, integrity, and proper functioning of the Service.
- Â To comply with legal obligations, respond to lawful requests, or establish, exercise, or defend legal claims.
We do not use consumer health data for advertising, and we do not use geofencing (establishing a virtual boundary around a physical location) to identify or track consumers seeking health care services, to collect consumer health data from those consumers, or to send them notifications, messages, or advertisements related to their consumer health data or health care services.
- CATEGORIES OF CONSUMER HEALTH DATA WE SHARE, AND WITH WHOM
We do not sell consumer health data, and we do not share it for advertising or marketing purposes. We share the categories of consumer health data described in Section 2 only with the following categories of affiliates and processors, and only as necessary to provide the Service:
- Story Fruition LLC personnel and internal systems, on a need-to-know basis, to operate and improve Missy.
- Cloud hosting and storage providers that store voice recordings, voiceprints, and related data on our behalf, under contracts that restrict their use of the data to providing services to us.
- AI and voice-cloning infrastructure providers that process voice data to generate coaching feedback and voice-cloned responses, under contracts that prohibit them from using the data to train their own general-purpose models.
We do not otherwise disclose consumer health data to third parties, and we require any processor or affiliate with access to consumer health data to delete it upon request consistent with Section 7 below.
- SALE OF CONSUMER HEALTH DATA
We do not sell consumer health data. If this ever changes, we will not sell consumer health data without first obtaining your valid, signed authorization meeting MHMDA's specific requirements, separate from the consent described in Section 8. Both we and any purchaser would retain a copy of that authorization for at least six years.
- YOUR RIGHTS
With respect to your consumer health data, you have the right to:
- Confirm and access. Confirm whether we are processing your consumer health data and obtain a list of the categories of third parties and affiliates with whom we have shared or sold it.
- Withdraw consent. Withdraw your consent to our collection or sharing of your consumer health data at any time.
- Delete. Request that we delete your consumer health data. We will honor that request and instruct any affiliate, processor, contractor, or other third party with whom we shared the data to delete it as well, subject only to the narrow exceptions MHMDA allows, such as detecting security incidents or fraud, or investigating or prosecuting wrongdoing.
- Appeal. Appeal our refusal to act on a rights request by contacting us using the information in Section 10.
We will respond to a rights request within a reasonable time and will not discriminate against you for exercising these rights.
- CONSENT
We obtain your affirmative, opt-in consent before collecting any consumer health data described in Section 2 that is not necessary to provide the Missy features you have specifically requested. Where we share consumer health data with a category of recipient described in Section 5 beyond what is necessary to provide the Service, we obtain a separate, additional consent for that sharing. You may withdraw your consent at any time by contacting [email protected]; withdrawing consent may limit or disable the voice features of the Service that depend on that data.
- DATA SECURITY AND RETENTION
We apply the same administrative, technical, and physical safeguards to consumer health data that we apply to other sensitive personal information, described in our Privacy Policy, and we contractually require any processor with access to consumer health data to implement appropriate safeguards and to delete the data upon request. Consumer health data is retained only as long as necessary for the purposes described in Section 4, and in any event no longer than the biometric data retention period described in Section 4 of our Privacy Policy (a maximum of three years from collection or account termination, whichever is sooner).

- RELATIONSHIP TO OUR OTHER POLICIES
This Consumer Health Data Privacy Policy supplements, and does not replace, our Privacy Policy (storyfruition.com/privacy-policy), Terms of Use (storyfruition.com/terms), and Cookie Policy (storyfruition.com/cookies). If any part of this policy conflicts with the Privacy Policy regarding the handling of personal information generally, this policy controls for consumer health data specifically, consistent with MHMDA.
- CHANGES TO THIS POLICY
We may update this policy from time to time to reflect changes in the law or our practices. We recommend reviewing this policy periodically; the next scheduled review is January 2027, alongside our Privacy Policy, Cookie Policy, Terms of Use, and DMCA Policy.
This policy is published as a precaution and does not concede that Missy's coaching data constitutes consumer health data under MHMDA in every instance; it describes the protections that apply to the extent it does.
